The petitioner seeks bail in connection with Dawath P.S. Case no. 14 of 2018 registered under Sections 30(a), 33/34 of Bihar Prohibition & Excise Act-2016.

60 lts. spirit is said to have been recovered from the bush behind the official residence of S.D.O. and petitioner who is said to be the guard of said residence was apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has been falsely implicated in the case at the instance of his enemy. He has no concern either with the seized liquor or with the place of recovery. He

Patna High Court Cr.Misc. No.19847 of 2018(2) dt.11-04-2018 2/2 had no knowledge of hiding the alleged liquor in the bush behind the aforesaid residence. He has no criminal antecedent. He has been languishing in custody since 13.02.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2nd-cum-Special Judge, Excise, Rohtas in connection with Dawath P.S.
