The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 8(c), 21(a) of N.D.P.S. Act.

Prosecution case relates to recovery of 8 sachet smack weighing about 8gm from the house of petitioner. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has falsely been implicated in this case due to local village politics. A statement has been made in para 3 of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the house in question from where the recovery has been made, is a joint house residing other family members also. It is

Patna High Court CR. MISC. No.49511 of 2022(3) dt.11-01-2023 2/2 further submitted that other co-accused from whose possession, smack was recovered, are getting privilege of regular bail granted by Learned Court Below. The petitioner is languishing in judicial custody since 31.1.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the fact that the petitioner is a lady, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Naubatput P.S. Case No. 58 of 2022 (Spl. Case No. 19 of 2022) on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XVIII, Patna.
