====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-12-2021 The learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 324, 307, 427, 379, 504 and 506/34 of the Indian Penal Code, registered in connection with Ahiyapur P.S.Case No.121 of 2020. It is a case of road rage and the allegation against the petitioners, who are father and son, is that they opened fire making the informant's side injured. The allegation against petitioner no.2 is that he assaulted the son-in-law of the informant by farsa.

Learned counsel for the petitioners has submitted that

Patna High Court CR. MISC. No.5862 of 2021(3) dt.15-12-2021 2/2 it is a case of road rage and good sense prevailed upon the parties and they have compromised the case, which reflects from the impugned order.

The learned APP has submitted that the opinion in respect of injuries are still awaited.

Considering the fact that both the parties have settled their dispute amicably, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M. Muzaffarpur in connection with Ahiyapur P.S.Case No. 121 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
