Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406, 468, 420/34 of the Indian Penal Code.

Accusation is of defalcation of Rs. 1,73,500/- and Rs. 65,000/- under the Jawahar Rojgar Yojana in the year 1992-93 and 1993-94. The petitioners were given the amount being the Executive Agent.

It is submitted by the learned counsel for the petitioners that though in the year 1994 the case was instituted. The petitioners were not apprehended since they have completed the work. Though, after institution of the First

Patna High Court Cr.Misc. No.33963 of 2014 (5) dt.27-03-2015 Information Report, now the charge-sheet has been submitted. Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Dariyapur P.S. Case No. 101 of 1994, pending in the court of learned Judicial Magistrate, Ist Class, Saran at Chapra.

With this observation this application is disposed of.
