JUSTICE SATYAVRAT VERMA ORAL ORDER 24-03-2022 Heard learned counsel for the petitioner, learned senior counsel for the informant, and learned APP for the State. The petitioner seeks bail in a case registered for the offences punishable under Sections 323, 341, 363, 376, 34 of the Indian Penal Code and Section 4 of the POCSO Act. The learned senior counsel for the informant, at the outset, submits that the trial has commenced and out of nine prosecution witnesses, two have been examined and three private witnesses are yet to be examined apart from other official witnesses.

The learned counsel for the petitioner submits that remaining private witnesses will appear before the Court below

Patna High Court CR. MISC. No.60156 of 2021(3) dt.24-03-2022 2/2 as and when required and will not unnecessarily delay the trial. Learned A.P.P. for the State will communicate this order to the Superintendent of Police, Kaimur at Bhabua to ensure that the official witnesses are present in the trial as and when required by the learned Court below.

Based on the submissions made by the learned senior counsel for the informant and learned counsel for the State, the learned counsel for the petitioner seeks permission to withdraw the bail application with a liberty to the petitioner to renew his prayer for bail in the event, if the trial is not concluded within nine months from the date of receipt/ production of a copy of this order.

Permission is accorded.

Accordingly, this application is dismissed as withdrawn.
