2. The petitioner seeks bail in Gopalpur P.S. Case No. 135 of 2024 registered for the offence punishable under Sections-25(1-B)A, 26, 35 of the Arms Act.

3. Allegedly, one country-made pistol and six live cartridges are said to have been recovered from possession of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from conscious possession of the petitioner. Drawing my attention towards impugned order of learned court below, learned counsel for the

No.52469 of 2024(3) dt.25-09-2024 2/2 petitioner has submitted that from perusal of the impugned order itself, it would appear that the petitioner was directed to renew his prayer for bail after three months and those three months are about to elapse. The petitioner is under incarceration since 2004-2024.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Naugachia, Bhagalpur in connection with Gopalpur P.S. Case No. 135 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court. (Nawneet Kumar Pandey, J) A.K.V.//- U T
