JUSTICE RAKESH KUMAR ORAL ORDER 10-12-2015 Heard Sri Rajeev Ranjan, learned counsel for the petitioner and Sri Md. Aslam Ansari, learned A.P.P. The petitioner, who is in custody since 2.9.2014 in connection with Hajipur Nagar P.S. Case No.594 of 2012 registered for the offence punishable under Section 392 of the Indian Penal Code, has prayed for grant of bail primarily on the ground that one of the co- accused namely Md. Asraf Ansari , who has disclosed the name of the petitioner has already been granted bail by this court vide Cr. Misc. No. 32116 of 2013. Similarly other co- accused persons have also been granted bail. It has been argued that save and except confessional statement of the co-accused Md. Asraf Ansari, there is no cogent evidence against the petitioner. It has been argued that petitioner has not
Patna High Court Cr.Misc. No.52758 of 2015 (2) dt.10-12-2015 2/2 been put on T.I. Parade nor he was got identified. In view of the fact that the co-accused who disclosed the name of the petitioner has already been granted bail, there is no reason to detain the petitioner.
Let the petitioner Vikash Choudhary @ Vicky Baitha be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate at Hajipur in connection with Hajipur Nagar P.S. Case No. 594 of 2012 with a condition that one of the bailors must be blood relation of the petitioner and secondly during the trial the petitioner shall remain physically present before the court below. If continuously on two dates he fails to appear without prior permission of the trial court, his bail bond shall stand automatically cancelled. (Rakesh Kumar, J) Praful/- U T
