Petitioner seeks bail in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code.
Some other miscreants were apprehended on suspicion that they were preparing to commit dacoity. The apprehended person disclosed the name of the petitioner as the person who had fled away from there.
Submission is that nothing has been recovered from possession of the petitioner. He is in custody since 13.10.2017. Investigation of the case is already complete. Only material is the confessional statement of the co-accused before the
Patna High Court Cr.Misc. No.8812 of 2018 (3) dt.26-03-2018 2/2 police and criminal antecedent of the petitioner. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chanpatia Police Station Case No. 335 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the court below.
