2. The petitioner who apprehends arrest in connection with Munger Mufassil P.S. Case No. 392 of 2024 lodged on 08.11.2024, for the offences punishable under Sections 126(2), 109, 303(2), 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of Arms Act.
3. As per the prosecution, four named accused persons including the petitioner, in connivance with each other, reached at the Chhath Ghat and started threatening the informant and when the same was objected, co-accused Khaltu Yadav resorted
Patna High Court CR. MISC. No.48530 of 2026(2) dt.22-07-2026 2/3 to fire upon the informant's brother. It is further alleged that in the meantime, the present petitioner also fired upon the informant who somehow saved his life.
4. It is submitted by learned counsel for the petitioner that the petitioner is innocent, has committed no offence and has falsely been implicated in this case due to dirty village politics. Learned counsel further submits that co-accused has already been granted bail by a co-ordinate Bench of this Court vide order dated 13.05.2026, passed in Criminal Miscellaneous No. 29657 of 2026. The petitioner is having one criminal antecedent in which he is on bail.
5. Learned APP for the State vehemently opposes the prayer for bail and submits that the order passed by a coordinate Bench of this Court (Annexure P/3), granting anticipatory bail to the co-accused clearly indicates that the allegations of firing is not against the said petitioner (coaccused).
6. In this background, this Court finds that the case of present petitioner is on different footing from the case of coaccused who has been granted anticipatory bail by a co-ordinate Bench of this Court, and is not inclined to grant bail to the present petitioner. Accordingly, the prayer for bail of the
Patna High Court CR. MISC. No.48530 of 2026(2) dt.22-07-2026 3/3 petitioner in connection with Munger Mufassil P.S. Case No. 392 of 2024, pending before the learned C.J.M., Munger is hereby rejected.
