In the present case, the bail was allowed on 22.08.2022 in Cr. Misc. No.27081 of 2022.

In the bail application, the Beldaur P.S. case was wrongly typed as Beldaur P.S. Case No.29/2021 instead of Beldaur P.S. Case No.291/2021.

Similarly, in the prayer portion of the bail application, instead of learned Judicial Magistrate, Ist Class, Khagaria the same was incorporated as learned Judicial Magistrate, Ist Class, Munger.

In that view of the matter in the bail order the aforesaid facts were incorporated.

The petitioner has now preferred bail application for

Patna High Court CR. MISC. No.47348 of 2022(2) dt.21-09-2022 2/3 modification vide Cr. Misc. No.47348 of 2022. The order is thus modified to the following extent: Para-3 would read as follows:

The petitioner is in judicial custody in connection with Beldaur P.S.

Case No.291/2021 instituted under Sections 356, 379 of the Indian Penal Code.

Similarly the prayer portion will read as follows: Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each in connection with Beldaur P.S. Case No.291/2021 to the satisfaction of Smt. Pallwi Anand, learned Judicial Magistrate, Ist Class, Khagaria, subject to following conditions:

(i) one of the bailor should be the family member of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial court

Patna High Court CR. MISC. No.47348 of 2022(2) dt.21-09-2022 3/3 and failure to do so for two consecutive dates without plausible reasons will entail cancellation of his bail by the Trial court itself;

(iii) the petitioner shall appear before the concerned police station every month for next six months to mark his presence;

(iv) the petitioner shall desist from committing any criminal offence again failing which the State shall be at liberty to steps for cancellation of his bail bonds.
