The petitioners apprehend their arrest in Karjain P.S. Case No. 06 of 2009, registered for the offences punishable under Section 308 and other Sections of the Indian Penal Code. The informant Md. Ibrahim alleged that the petitioners and others had gone to cut the trees of the informant. When the informant objected, on such the accused persons assaulted the informant and others.
Learned counsel for the petitioners submits that there is case and counter case. The petitioners are co-sharer. There is
Patna High Court Cr.Misc. No.32814 of 2014 (2) dt.04-02-2015 land dispute. The injuries found on the persons of the injured are simple in nature. Cognizance under Section 308 and other Sections of the Indian Penal Code has been taken. On considerations of the facts, that there is land dispute between the parties, from both sides case and counter case have been filed, the injured got simple injuries and there is omnibus allegation of assault, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate Ist Class, Birpur at Supaul in connection with Karjain P.S. Case No. 06 of 2009, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
