JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-01-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bikramganj P.S. Case No. 237 of 2014 registered under Section 302 and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, coaccused, Jitendra Nut confessed his guilt committing the murder of the deceased with the help of co-accused, Bigan Ram with statement that this petitioner took the mobile set to the pocket of the deceased and taking the SIM thereafter handed over the mobile to him. It is further submitted that co-accused, Surendra Singh

Patna High Court Cr.Misc. No.54748 of 2015 (3) dt.11-01-2016 Yadav @ Naga Yadav @ Nagdeo Yadav, has already been granted privilege of bail by this Court vide order dated 23.09.2015 passed in Criminal Misc. No. 25110 of 2015 and he is in custody since 01.01.2015, whose name has come in the confessional statement of co-accused, Jitendra Nut.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional District and Sessions Judge, Rohtas, in connection with S.T. No. 385 of 2015 arising out of Bikramganj P.S. Case No. 237 of 2014. Out of two sureties, one surety must be the close relative of the petitioner.
