The petitioner seeks bail in a case instituted for the offences under Section 394 of the Indian Penal Code. Prosecution allegation, in short, is that the accused persons forcibly entered into the truck and assaulted the driver and tried to commit loot of truck.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.5.2019 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. No article is alleged to have been looted. The petitioner has falsely been implicated in the present case. The informant had parked the vehicle on the

Patna High Court CR. MISC. No.47054 of 2019(2) dt.30-07-2019 2/2 road due to which jam has taken place. The petitioner protested the same and for the said reason, the present case has been instituted.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S. Case No. 126/19.
