The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 341, 323, 379, 384, 504, 506 of the Indian Penal Code.
The prosecution case is that on 24.02.2015 at 9.00 P.M. in the night the accused persons came variously armed, assaulted the informant, his wife, his daughter-inlaw and the son and resorted to fire. It is specifically
Patna High Court Cr.Misc. No.3612 of 2016 (2) dt.22-01-2016 alleged that co-accused Abodh Yadav @ pushed down the informant on the ground and put pistol on his chest in order to kill him and snatched gold chain of the daughterin-law of the informant worth Rs.40,000/-. Petitioner no. 1 Sarjug Yadav @ Saryug Yadav snatched Rs.5,00/- from the son of the informant, whereas petitioner no. 2 Chhotu Yadav @ Shyam Kumar took out a box containing jewellary and clothes.
It is submitted by the learned counsel for the petitioners that accusation has been levelled in the background of litigated relationship between the parties and for the same proceeding is pending between the parties. The accusation of assault is omnibus and general. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent and there is counter version of the occurrence being Complaint Case No. 152C of 2015.
Considering the nature of accusation being levelled in the background of litigated relationship between the parties, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri Arbind Kumar Singh, J.M., Ist class, Munger in connection with Asarganj P.S. Case No. 17 of 2015, subject to conditions as laid
