The petitioner seeks bail in Chenari P. S. Case No. 262 of 2018 instituted for the offence under Section(s) 147,148,149, 341, 385,387,323, 354, 354B, 324, 379 and 506 of the Indian Penal Code.

The allegation against the petitioner is of snatching the purse from the lady Mukhiya. The petitioner along with others have been made accused.

It is submitted that in the charge-sheet submitted by the police Section 379 of the Indian Penal Code has been omitted. The other co-accused of this case have been allowed the privilege of anticipatory bail under order dated 20.06.2019 passed in Cr. Misc. No. 37433 of 2019. One of the co-accused

Patna High Court CR. MISC. No.46377 of 2019(3) dt.27-09-2019 2/3 persons of the instant case has been allowed bail under order dated 08.08.2019 passed in Cr. Misc. No. 35572 of 2019. The petitioner has been implicated in this case due to village politics. It is further highlighted that in other cases pending against the petitioner, he is already on bail.

In the instant case, petitioner is in custody since 01.06.2019 Learned A.P.P. for the State opposed the prayer for bail.

Having considered the rival submissions of the parties, prayer for bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Chenari P. S. Case No. 262 of 2018, subject to the following conditions:-

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
