The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1-A), 25(1-B) AC/26 (1) (2) (3)/35 of the Arms Act. On raid being laid by the raiding party, some persons are manufacturing arms, when Pradip Paswan and Santosh Kumar were apprehended. The police recovered some finished and some semi finished arms. The apprehended accused persons suggested the name of the miscreants including the petitioner.
It is submitted by the learned counsel for the petitioner that only on confession of co-accused there is nothing against the petitioner. The impugned order does not suggest any further material against the petitioner. Statement
Patna High Court Cr.Misc. No.3739 of 2016 (2) dt.25-01-2016 has been made in para-3 of the petition that petitioner has no criminal antecedent. Moreover, similarly situated accused Md. Sintu has been granted bail by a Coordinate Bench of this Court vide Cr. Misc. No. 20029 of 2014.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M., Ist Class, Munger in connection with Dharhara P.S. Case No. 121 of 2013, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
