Petitioner, already in custody, seeks bail in connection with Kharik P.S. Case No.229 of 2017, registered under Sections 20 and 22 of the NDPS Act.

Allegation in brief is that while the petitioner was already in custody in a case under the Excise Act, police received information that he also deals in narcotic and 3 kgs. of ganja was recovered from his house kept under husk. Submission of the learned counsel for the petitioner is that the petitioner was already in custody and recovery is made from a temporary structure used for keeping husk and accessible to anyone and the quantity of ganja is only 3 kgs.
