Petitioner apprehends arrest in a case registered for the offences punishable under Sections 323, 379, 504/34 and other sections of the Indian Penal Code.

As per prosecution case, petitioner and other accused persons misbehaved and threatened to assault the informant and her family members.

Learned counsel appearing for the petitioner submits that a simple altercation took place between the parties due to dispute in respect of pathway. Petitioner is innocent and has falsely been implicated in this case. There is no specific allegation of overt act against the petitioner. Case and counter

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Darbhanga in Sadar P.
