2. The petitioner seeks regular bail in connection with Barh P.S. Case No. 254 of 2023, registered for the offence punishable under Sections 25(1-b)a, 26 of the Arms Act.

3. As per prosecution, one country made pistol and one live cartridge has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent and he is in custody since 29.04.2023. No incriminating material has been recovered from the possession of the petitioner.

5. Learned APP has vehemently opposed the prayer

Patna High Court CR. MISC. No.50001 of 2023(2) dt.19-08-2023 2/2 for bail.

6. Considering the aforesaid fact also considering the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail after completing six months in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, 1st Barh, District-Patna in connection with Barh P.S. Case No. 254 of 2023.
