The petitioner seeks bail in Kuchaikote P.S. Case No. 170 of 2017 (GR No. 2290 of 2017) registered under Sections 413 and 414 of the Indian Penal Code.
On a tip off, police apprehended the petitioner and one Imran Alam along with stolen motorcycle and on the basis of the confessional statement of Imran Alam, two other stolen motorcycles were recovered and seized.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner rather the stolen motorcycle is said to have been recovered jointly from the possession of the
Patna High Court Cr.Misc. No.21674 of 2018 (2) dt.11-04-2018 2/2 petitioner and Imran Alam. Virtually the said motorcycle was in possession of Imran Alam and the petitioner had no knowledge of the said motorcycle to be stolen one. He had simply accompanied him on the call given by Imran Alam and in the meantime, he was arrested along with him. The petitioner has been languishing in custody since 26.08.2017. Earlier bail prayer of the petitioner was rejected by this court vide order dated 20.09.2017 with liberty to renew his prayer for bail after framing of charge and now the charge in the case has been framed on 20.02.2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Gopalganj in connection with Kuchaikote P.S. Case No. 170 of 2017 (GR No. 2290 of 2017).
