The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016. As per allegations in the FIR, it is stated by the informant that on a raid being conducted 670.32 litres of IMFL was recovered from the house of the petitioner and he was taken into custody. It is further stated that large number of villagers etc. gathered there, started to assault the police personnel, caused injuries and got the petitioner released from the police custody.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.6798 of 2021(4) dt.02-09-2021 2/2 that the allegations as levelled in the FIR are false and concocted. The petitioner with dozens of other accused persons which also included the lady members of the family were implicated for oblique reasons. The petitioner is in custody since 31.8.2020 and large number of co-accused, whose orders have been brought on record as Annexure-2 series to this petition, have been enlarged on bail including anticipatory bail. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with Maniyari P.S. Case no. 246 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
