JUSTICE RAKESH KUMAR ORAL ORDER 07-12-2015 Heard Sri Raghvendra Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 30.08.2015 in connection with Barsoi P.S. Case no.202/2015 registered for the offence under Section 47(A) of the Excise Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner was a salesman in a shop of one Sarfaraz Alam, from which shop huge quantity of illegal country liquor was shown recovered. He further submits that the petitioner is having clean antecedent.

Keeping in view the nature of accusation and period of custody as well as the fact that the petitioner is having clean

Patna High Court Cr.Misc. No.52523 of 2015 (2) dt.07-12-2015 2/2 antecedent, let the petitioner, namely, Prithwi Lal Sah be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Barsoi P.S. Case no. 202/2015.
