Petitioner is accused in connection with Mithanpura P.S. Case No. 188 of 2015 registered under Sections 461, 379 and 411 of the I.P.C.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, co-accused Sushil Paswan apprehended by the Police, who confessed his guilt about committing the theft in the present case with further contention that he has sold the stolen gold to the shop of the petitioner and hereafter, 88 grms. gold articles was recovered from the shop of the petitioner. In fact, the petitioner is the Gold Smith and has purchased the recovered

Patna High Court Cr.Misc. No.50972 of 2015 (2) dt.18-12-2015 2/2 articles from co-accused Sujeet Paswan, being the bona fide purchaser. It is also submitted that petitioner has no criminal antecedent and is in custody since 09.08.2015. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Muzaffarpur in connection with Mithanpura P.S. Case No.188 of 2015.
