Petitioner apprehends her arrest in Noor Sarai P.S. Case No. 22 of 2014 registered under section 302/34 of the Indian Penal Code. According to the prosecutin case the informant married his daughter Gayatri Devi with Kamlesh Yadav. His daughter got three children. The informant informed that his daughter was found hanging herself and has committed suicide. It is alleged that the petitioner had quarrel with the daughter of the informant one day prior to the occurrence. Learned counsel for the petitioner submits that initially the case was registered under section 302/34 of the I.P.C. but later on after investigation police submitted charge sheet under section 306 of the I.P.C. The marriage was solemnized ten years ago. There is no demand of dowry. It has come in evidence that for uprooting the Neem tree the victim has committed suicide

No.32818 of 2014 (2) dt.03-02-2015 2/2 Learned counsel for the informant opposed the prayer for anticipatory bail and on perusal of record it appears that the informant is not an eye witness of the occurrence. It has come in evidence that the daughter of the informant picked quarrel for uprooting the Neem Tree and thereafter she committed suicide. The police after investigation submitted charge sheet under section 306 I.P.C.
Considering the aforesaid fact, the above named petitioner in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt /production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M, Nalanda at Biharsharif in Noor Sarai P.S. Case No. 22 of 2014, subject to the conditions as laid down under section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) M.Rahman/- U T
