JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

The prosecution case is that the informant fixed the marriage of his daughter with petitioner no. 2 and Petitioner no. 1 is father of petitioner no. 2 when seven lacs rupees were paid but subsequently the petitioner no. 2 refused to perform marriage. It is submitted by the learned counsel for the petitioners that the informant's daughter was in love with some other boy and she performed marriage in the temple. There is no proof with regard to payment of money to the petitioners. The FIR reflects

Patna High Court Cr.Misc. No.3725 of 2016 (2) dt.25-01-2016 2/2 that after marriage of the daughter of the informant with some other boy the present FIR has been lodged.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Mufassil P.S. Case No.232 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
