The petitioner has preferred this application for grant of regular bail in a case registered under sections 366A and 34 of the Indian Penal Code.

As per the prosecution case, the petitioner is said to have kidnapped the 17 year old daughter of the informant. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The same would be evident from the fact that the daughter of the informant returned and her statement was recorded under section 164 Cr.P.C. which has been brought on record as Annexure-2 to the petition. In the said statement, she describes herself to be aged 18 years and she has categorically stated

Patna High Court CR. MISC. No.61371 of 2021(2) dt.11-04-2022 2/2 therein that she went with the petitioner and married him on her own free will. The petitioner is in custody since 9.8.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the daughter of the informant having returned, the contents of the statement of the daughter of the informant under section 164 Cr.P.C. and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Dariyapur P.S. Case no.359 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-13, Saran at Chapra.
