JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 This application, for grant of anticipatory bail, arises out of Kahalgaon (Ghogha) P.S. Case No. 237 of 2019, disclosing offences under Sections 420, 379 of the Indian Penal Code, Section 21(1) MMD & R Act, 1957, and 40(8) MMC Rule 1972/2017 and Section 15 of the Forest & Environment Protection Act, 1986.

Allegation against the petitioner is of running brick kiln without renewing his license.

Submission of learned counsel for the petitioner is that he has applied for renewal of license and has also deposited the requisite fee but the license has not been renewed and he is a businessman and there is no chance of his absconding and he is ready to abide by any condition imposed on him. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon (Ghogha) P.S. Case No. 237 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
