The petitioner apprehends his arrest in Nagar P.S. Case No. 415 of 2013, registered for the offences punishable under Sections 420, 467, 471 of the Indian Penal Code and Section 10 of the Examination Control Act.

Allegation against the petitioner is that one Sanjay Kumar impersonated the petitioner and he appeared at the examination in place of the petitioner.

Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot. There is no material to show that the petitioner set up Sanjay Kumar to appear in his place at the examination.

On perusal of records, it appears that the petitioner

Patna High Court Cr.Misc. No.32810 of 2014 (2) dt.04-02-2015 set up Sanjay Kumar to appear in the examination in his place, hence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
