ANJANA MISHRA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 379/411/353 and 349 of the Indian Penal Code. Learned counsel for the petitioners submits that they have been named in the First Information Report but there has been no recovery from their possession. It has been submitted that allegation is that coal was transported through a boat after stealing from the Railways and 60 bags of coal were recovered from one Niranjan Kumar @ Nirua Mandal who was apprehended. So far as the petitioners are concerned, their names have surfaced on the basis of confession statement of said Niranjan Kumar @ Nirua

Considering the aforementioned facts and circumstances and that other co-accused persons namely, Bonga Mandal whose name has also surfaced in similar manner, has also been extended the privilege of anticipatory bail in Cr. Misc. No. 2771 of 2016 vide order dated 21.01.2016, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Bhagalpur in connection with Kahalgaon P.S. Case No. 350/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
