Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 379, 420 of the I.P.C, Sections 41, 42 of the Forest Act and Section 40 of Mines and Minerals(Development and Regulation) Act. It is alleged that petitioners cut the trees from the land of the government and dig the soil for the purpose of construction of bricks.
It is submitted by learned counsel for the petitioners that the land in question was settled between Ram Das Ram and Ram Prasad Ram. The petitioner Sunil Kumar Mehta took the land from the Ram Das Ram for agriculture purpose but it does not reflect that there was any tree on the land in question. Hence on suspicion the accusation has been levelled.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad(M) P.S. Case No. 14 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
