JUSTICE MADHURESH PRASAD ORAL ORDER 05-04-2018 Heard counsel for the petitioner and APP for the State. Petitioner is an accused in a case registered for offence under section 395 of the IPC.

It is submitted by the counsel for the petitioner that on the basis of allegation regarding loot of some money, two police cases have been lodged and the petitioner has been implicated in both cases. In one of the cases, bearing Ramgarh (Nuaon) Police Station Case No. 313 of 2017 arising out of the same allegation he has already been allowed bail vide order dated 13.3.2018, passed in Cr.Misc.No. 14264 of 2018. In the instant case, other than the statement of co-accused there is nothing to implicate the petitioner. Petitioner has no criminal antecedent and there is no recovery of incriminating article from him and he is in custody upon his remand in this case on 12.1.2018.

In the facts and circumstances of the case, prayer for bail

Patna High Court Cr.Misc. No.12425 of 2018 (3) dt.05-04-2018 2/2 of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in Kudhani Police Station Case No. 22 of 2017 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.

(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
