The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and sections 3/ 4 of Bihar Prevention of Witch Practice Act,1999.

As per the prosecution case, the accused persons including the petitioner are said to have assaulted the husband of the informant leading to fracture of his left upper hand. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case. Referring to the injury report, it is submitted that as per first information report, the injury attributed to the petitioner has been found to be simple in nature. The petitioner is in custody since 31.07.2021, has no criminal antecedent and charge sheet

Patna High Court CR. MISC. No.60414 of 2021(3) dt.11-04-2022 2/2 has been submitted in this case.

Having heard learned counsel for the parties and taking into consideration the facts of the case the material that has transpired in course of investigation, the injury report of the husband of the informant together with the fact of the petitioner having remained in custody for eight months, the Court directs the petitioner to be enlarged on bail in connection with Mashrak P.S. Case no. 271 of 2020 on furnishing bail bond of Rs 10,000/ (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra.
