The petitioner is mother-in-law, who is apprehending her arrest in connection with Aungari (Pirbigha O.P.) P.S. Case No. 44/2015 registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code. The case diary in the present case was called for which has been received.
The learned counsel for the petitioner submits that the petitioner is residing separately from her son and daughter-inlaw and later on the deceased was done to death. It is further submitted that the husband of the petitioner has already been allowed regular bail and the husband of the deceased is also in
Patna High Court Cr.Misc. No.3741 of 2016 (3) dt.11-04-2016 custody.
Considering the aforementioned facts and circumstances of the case and that there is no specific allegation against the petitioner, let the petitioner above named, in the event of her arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hilsa (Nalanda) in connection with Aungari (Pirbigha O.P.) P.S. Case No. 44/2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
