The petitioner is apprehending arrest in a case registered for the offences punishable under sections 457,380 and 411/34 of the Indian Penal Code.

The prosecution case is that the petitioner being cook of Mid-day-meal of the school has been found the rice of Mid-day-meal in his house. From his house six bags of rice were recovered.

It is submitted by the learned counsel for the petitioner that the rice was kept with the permission of the Headmaster of the school and the Headmaster of the school has been granted anticipatory bail. Statement has been made in

Patna High Court Cr.Misc. No.3687 of 2016 (2) dt.25-01-2016 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the nature of recovery and Statement that the petitioner has no criminal antecedent, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Minapur P.S. Case No. 28 of 2015 pending in the court of learned CJM, Muzaffarpur. This application is disposed of with the aforesaid observation/direction.
