2. The petitioner who has been working as a Tola Shikshak Sevak at Government Primary School, Paraul, Mushahari under Benipatty Block, Madhubani has approached this Court seeking a direction upon the respondent authorities to make payment of arrears of honorarium/salary for the period from July, 2016 to March, 2017 alongwith with statutory interest. It is submitted that despite the petitioner having

Patna High Court CWJC No.13631 of 2025(2) dt.01-09-2025 2/2 approached before all the authorities and filed representation for payment of his due honorarium/salary, till date, no action has been taken.

3. Learned Advocate for the State submitted that since the petitioner has already approached before the authorities concerned, they will look into the matter and ensure payment of due honorarium, if admissible.

4. Having considered the submissions set forth, this Court directs the District Programme Officer (Literacy), Madhubani to look into the matter and pass an appropriate order for payment of due honorarium/salary for the period aforenoted, preferably within a period of 8 weeks from the date of receipt/production of a copy of this order.

5. It is made clear that non-payment of salary for the work performed amount to "begar" and to "forced labour", a practice which is impermissible under Article 23 of the Constitution of India besides transgressing the right to life.

6. The present writ petition stands disposed off with the aforesaid direction.
