Heard learned counsel for the petitioner and the State. The petitioner prays for grant of bail in a case registered for the offence punishable under section 30(a) of the Bihar Prohibition & Excise Act, 2018.

As per prosecution case, 195 country made liquor was recovered from the car in which petitioner was sitting and was arrested on the spot.

Learned counsel for the petitioner submits that the petitioner is neither owner nor driver of the car in question and was simply co-passenger. Petitioner has got clean antecedent. Petitioner is in jail custody since 06.10.2020. Considering the aforesaid facts and circumstances as

No.6440 of 2021(2) dt.15-04-2021 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. District and Sessions Judge II-cum- Special Judge Excise, Aurangabad in Excise case no. 994/2020 on the following conditions.

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be canceled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
