1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Simri Police Station Case No. 35 of 2024, dated 10.03.2024, disclosing offences punishable under Sections 341/323/354/379/34 of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that on 23.02.2024, in the evening at about 5 PM, the petitioners, along with other accused persons, entered into the room of the informant, tried to outrage her modesty, threatened the informant to marry co-accused Priyanshu

Patna High Court CR. MISC. No.54431 of 2024(2) dt.31-08-2024 2/3 Singh and petitioner no. 1 and co-accused Priyanshu Singh snatched her mangal sutra and ear-ring.

4. Learned Counsel for the petitioners submits that the petitioners have falsely been implicated in this case due to dispute regarding distribution of share in the family property. He further submits that the alleged occurrence has taken place on 23.02.2024, but the First Information Report has been lodged on 10.03.2024, after about 17 days delay. The petitioner no. 1 is the father-in-law of the informant, petitioner no. 2 is the mother-in-law of the informant and petitioner no. 3 is the cousin brother-in-law of the informant; whereas co-accused Priyanshu Singh is the own brother-in-law of the informant.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the nature of allegation and the fact that the petitioner nos. 1 and 2 are the father-in-law and mother-in-law of the informant and there appears to be dispute regarding share in the family property, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.
