The petitioner seeks bail in Risiup P.S. Case No. 88 of 2020, registered for the offence under Sections 364, 365, 302, 201, 120(B) of the Indian Penal Code.

As per the F.I.R., this petitioner along with other coaccused abducted the informant's son and killed him. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the confessional statement of co-accused, Bhupesh Kumar Singh and except the confessional statement there is no other material to suggest the complicity of this petitioner in the aforesaid

Patna High Court CR. MISC. No.60634 of 2021(3) dt.25-03-2022 2/2 crime. Petitioner claims clean antecedent and he is in custody since 28.12.2020. Chargesheet has been submitted. However, learned A.P.P. for the State and the informant opposed the bail petition and submitted that on the disclosure made by this petitioner clothes of the deceased were recovered which were duly identified by the mother of the deceased.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
