2. Petitioners apprehend arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.

3 . It is alleged that 11.7 liters of illicit liquor was recovered from bag which was allegedly thrown by these petitioners.

4. It is submitted that the petitioners are innocent and have falsely been implicated in this case . The name of the petitioner transpired during course of investigation . No incriminating material has been recovered from the conscious

Patna High Court CR. MISC. No.48891 of 2025(2) dt.21-07-2025 2/2 possession of these petitioners and they are no way connected with the aforesaid recovery . Recovery is from open place . Petitioner no. 1 has got 2 criminal antecedents out of which 1 is of similar nature in which he is on bail and petitioner No. 2 has got 1 criminal antecedent in which he is on bail. 5 . Learned counsel for the State opposes the bail petition .

6. Considering the aforesaid facts and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let these petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive special Judge Excise Court II, Bettiah West Champaran in connection with Srinagar Police Station Case No. 138 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
