1. Heard learned counsel for the petitioner as well as learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act in connection with Alamganj P.S. Case No.378 of 2021.

3. The learned counsel for the petitioner submits that the petitioner has antecedent of four cases and allegation is of recovery of 320 liters of liquor from a boat.

4. It is next submitted that petitioner was not arrested from the spot as such nothing was recovered from his conscious possession and during the course of investigation he came to be arrested and is in custody since 27.06.2024.

5. The learned APP for the State opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner and the fact that petitioner was not arrested from the spot, the petitioner above-named is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise, Patna City, Patna in connection with Alamganj P.S. Case No.378 of 2021.

7. The application stands allowed.
