09-12-2015 Heard Sri Hari Shankar Rai, learned counsel, who was assisted by Sri Satyendra Kumar Singh, learned counsel for the petitioner and Sri Parmeshwar Mehta, learned Addl. Public Prosecutor.

The petitioner, who is in custody in Mahnar P.S. Case No. 245 of 2014 registered for the offence under Section 302 & other allied sections of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that against the petitioner, there is general and omnibus allegation, whereas, specific accusation for giving knife blow is against one Ram Bali Sahni. He further submits that in identical situation, number of co-accused have been granted bail.

Patna High Court Cr.Misc. No.52607 of 2015 (2) dt.09-12-2015 2/2 Learned Addl. Public Prosecutor has opposed the prayer for bail.

I have perused the materials available on record. There is general and omnibus allegation and moreover, three accused persons, having similar accusation namely Ramashray Sahni, Bisheshwar @ Bisheshwar Sahni and Bahoran Prasad, have already been extended the privilege of bail, vide Cr. Misc. No. 11136 of 2015, 31322 of 2015 and 36170 of 2015 respectively. In view of facts and circumstances, let the petitioner namely Khublal Sahni be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur/concerned court in connection with Mahnar P.S. Case No. 245 of 2014.
