The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.
It is submitted that there is no allegation that the petitioner has shot fire killing the wife of the informant. Learned counsel for the State submits that there is specific allegation that the petitioner went to the house of the informant in the dead of night and abused him and when his wife asked not to abuse, at the instance of the petitioner, co-accused Sachin Bhagat shot fire which caused injury to the wife of the informant and she succumbed to the injuries.
Patna High Court Cr.Misc. No.32499 of 2014 (2) dt.02-02-2015 2/2 Considering the facts and circumstances, in my opinion, the petitioner does not deserve anticipatory bail. His prayer is rejected.
