JUSTICE ARUN KUMAR ORAL ORDER 07-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Halsi (Ramgarh Chowk) P.S. case No. 142 of 2016 instituted under Sections 341, 323, 325, 307, 354, 379, 504, 506/34 of the Indian Penal Code.

The allegation, in brief, is that the accused persons assaulted with stick and lathi to the informant's wife and when he objected accused Kailash Das gave severe blow on his head. It is submitted that there is no specific allegation against these petitioners and it is simple case of assault and all the injuries on the informant and his wife including the injuries caused by Kailash Das are simple in nature. It is also submitted that the

Considering the aforesaid facts and circumstances of the case, let the petitioners, namely, Dharmendra Das, Shrawan Das and Dasrath Das in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Halsi (Ramgarh Chowk) P.S. case No. 142 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
