The present writ application has been filed for quashing of e-auction sale notice, published in the newspaper 'Dainik Jagaran', dated 20.07.2023, fixing the date of auction on 12.09.2023, for sale of the mortgaged property of the petitioner in terms of the order, dated 10.07.2023, passed by the Chairman, Debt Recovery Tribunal, Patna, in Case No. 359 of 2022.

3. Learned Counsel for the Bank submits that during the pendency of this writ application and before auction, the petitioner has deposited entire outstanding dues towards the settlement of loan account and, now, the entire loan

Patna High Court CWJC No.10987 of 2023(4) dt.12-02-2024 2/2 amount has been paid and this matter has, now, become infructuous.
