2. The petitioner seeks regular bail in connection with Bangao P.S. Case No. 100 of 2023 registered for the offence under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and later on Section 302 of IPC was added and Section 27 of the Arms Act.

3. As per the FIR, one Suman Yadav is the assailant of the deceased.

4. Learned counsel for the petitioner submits that in the trial all the four witnesses have been examined. All the four witnesses have not supported the prosecution case and have not identified the accused persons. Petitioner is in custody since 01.10.2023.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the period of custody and the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Saharsa/concerned Court below in connection with Bangao P.S. Case No. 100 of 2023 subject to condition that:- (i). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.
