The petitioner apprehends his arrest in Araria (Bairgachi) P.S. Case No. 187 of 2021, registered for the offences punishable under Sections 302, 201 of the Indian Penal Code.

Prosecution case in brief is that this petitioner along with his associates committed murder of the son of informant. It is submitted on behalf of petitioner that there is no eye-witness to the occurrence. Petitoner has been made accused in this case only on suspicion because he went along with the deceased on 21.02.2021 and the dead-body was found on 23.02.2021. In fact, the deceased had criminal background and it appears that he might have been killed by his associates. Petitioner claims clean antecedent.

Patna High Court CR. MISC. No.59636 of 2021(2) dt.05-07-2022 2/2 Counsel for the State vehemently opposed the prayer for bail and submitted that this petitioner went along with the deceased on the alleged date of occurrence and after two days dead-body of the deceased was recovered. During course of investigation in call detail report (CDR), petitioner was found in conversation with other co-accused persons.

Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
