2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 461 and 379 of the Indian Penal Code, registered in connection with Town P.S. Case No. 33 of 2024.

3. As per the prosecution case, on 11.01.2024 in the night theft was committed by unknown thief in the jwellery shop of the informant in which silver and gold ornaments have been stolen. Accordingly, this case was registered against unknown.

4. The learned counsel for the petitioner has submitted that name of the petitioner has been figured only on the

Patna High Court CR. MISC. No.55009 of 2024(2) dt.20-08-2024 2/2 confessional statement of co-accused Chandra Shekhar @ Shekhar. Nothing has been recovered from his possession. He is under custody since 28.04.2024.

5. Learned APP appearing for the State has opposed the prayer of Bail.

6. Considering the above-mentioned facts and circumstances of the case specially the fact that confessional statement is not relating to recovery, let the petitioner, above named, be released on bail on furnishing the bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Town P.S. Case No.33 of 2024, subject to the condition that petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court.
