2. In the present case, the petitioner seeks bail in connection with Ramgharwa P.S. Case No. 194 of 2026, registered on 15.04.2026 for the offences under Sections 309(4) of the BNS.

3. As per the prosecution case, the informant ran away from her house along with her lover taking the jewellery worth Rs.5 lakh on a motorcycle being driven by co-accused Nehal Alam. They were robbed by three miscreants of their jewellery and mobile phones. The name of the petitioner transpired during investigation for being involved in the robbery.

Patna High Court CR. MISC. No.48158 of 2026(2) dt.22-07-2026 2/3 petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. The name of the petitioner came in the present case in the confessional statement of co-accused Nehal Alam and recovery of alleged articles were also made from co-accused Nehal Alam and one Laddu Kumar. Nothing incriminating has been recovered from the person or possession of the petitioner. No Test Identification Parade has been carried out till date. The petitioner is in custody since 17.04.2026 and charge sheet has been submitted. Similarly placed co-accused, Arshad Babu has been granted bail by a Coordinate Bench of this Court vide order dated 30.06.2026 passed in Cr. Misc. No. 41549 of 2026. Petitioner has no criminal antecedent.

5. Learned APP appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that no recovery has been shown from the petitioner and further considering grant of bail to co-accused person and also considering the period of custody of the petitioner, his clean antecedent and submission of charge sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties

No.48158 of 2026(2) dt.22-07-2026 3/3 of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Raxaul at Motihari, East Champaran/concerned court, in connection with Ramgharwa P.S. Case No. 194 of 2026, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
