Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Allegation is that petitioner committed murder of the daughter of the informant for dispute relating to partition of the family property.

Submission is that there is no eyewitness of the occurrence. The doctor did not find any external injury on the person of the deceased, rather a case of hanging was noticed, which might be a case of suicidal death. The wife of the petitioner, namely, Anarsi Devi has already been allowed bail by a co-ordinate Bench of this Court, vide Annexure 3.

No.49977 of 2019(2) dt.09-08-2019 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Dumra Police Station Case No.300 of 2018, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
