Petitioners are apprehending their arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

Accusation is of looting Rs. 53,000/- and gold chain of the informant, leading to registration of First Information Report against unknown.

It is submitted by the learned counsel for the petitioners that the name of the petitioners sprang up during investigation on the confession of co-accused Santosh Kumar. Except the confession of co-accused nothing has been levelled against the petitioners. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. The

Patna High Court Cr.Misc. No.3751 of 2016 (2) dt.25-01-2016 impugned order also does not suggest any material except the confession of co-accused.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Maniyari P.S. Case No. 253 of 2014, pending in the court of learned SubDivisional Judicial Magistrate, West, Muzaffarpur. With this observation this application is disposed of.
